The Committee of Ministers of the Council of Europe at the beginning of October will analyze the implementation of the judgments of the European Court for Human Rights in Strasbourg on the case “Sejdić-Finci” against B&H “and will seek clarification and the response of the institutions of B&H as to why the verdict has not been implemented so far and when it would be implemented, said Mary Ann Hennessey, the Chief of the Office for the Council of Europe in B&H to Fena She reminded that the deadline for the implementation of the verdict was two and a half years ago, which is six months after the judgment was finalized.
“Then the Parliamentary Assembly of the Council of Europe in early October will evaluate the progress report on B&H, and will be followed by a debate as Parliament on what will be the consequences of non-implementation of the judgment “Sejdić -Finci” in the Constitution of B&H and the Election’s Law of B&H before the general elections in 2014”, explained Hennessey.
The Head of the Office of the Council of Europe did not speak of the possible consequences for B&H , but she said that if the elections will be organized in October 2014, the case must be called in May, for which it is clear that there is still very little time to implement the judgment.
“The Council of Europe will very carefully consider the elections of 2014 and how it will all go on, and by the spring of next year, it will have to be organized in accordance with the judgment of the European Court for Human Rights”, she said.
Hennessey stated that she cannot certainly claim that there will be consequences, but the institutions of the Council of Europe will have to take into account the fact that the member state of the Council of Europe is still not able to guarantee full human rights to all its citizens.
The President of the Democratic Action Party (SAD) Sulejman Tihić, earlier stated for agency Fena that the representatives of this party will seek solutions that will be in accordance with the European Convention of Human Rights, but would not agree on asymmetric solutions.
On the other hand, the President of the Serbian Democratic Party (SDS) Mladen Bosić said he does not see any progress in resolving the case “Sejdić-Finci” and expressed concern that if this situation remains the same until October, B&H could be declared as “an impossible case”, adding that this response is expected from the political parties in the FBiH.
However, Prime Minister of the RS Zeljka Cvijanović said that due to approaching deadlines, hopefully B&H political leaders will agree on solutions regarding the implementation of the verdict “Sejdic-Finci”, adding that non-implementation of the judgment represents an obstacle to the future development of B&H towards Europe.
