Ruling on Prosecutor’s Custody Motion against the suspects in the case of Frane Gavranović et al., on 27 January 2019 the Court of Bosnia and Herzegovina issued a decision ordering pre-trial custody for Frane Gavranović and Duško Simkić on the statutory grounds set forth in Article 132(1), Subparagraphs a), b) and c) of the BiH Criminal Procedure Code, which is the flight risk, the concern that they may destroy, conceal, alter or forge evidence or clues important for the criminal proceeding, that they may hinder the criminal proceedings by interfering with the witnesses, accomplices or accessories, and due to the fear that they may repeat the criminal offense or finish the attempted one.
Under the Decision, pre-trial custody may last for a maximum of 1 (one) month, running from the day of arrest, which means until 24 February 2019 or pending a different decision of the Court.
Frane Gavranović and Duško Simkić are suspected of the criminal offense of Organized Crime under Article 250(2) as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) of the Criminal Code of Bosnia and Herzegovina (CC BiH).
