Ruling on the Motion filed by the BiH Prosecutor’s Office to order custody of the suspect Munib Ahmetspahić, on 27 November 2018 the Court of Bosnia and Herzegovina issued a decision granting the Motion. According to the Decision, the pre-trial custody may last for a maximum of one month, running from the day of his arrest, which means until 22 December 2018 or until a new decision of the Court. Pre-trail custody was ordered on the statutory grounds set forth in Article 132(1), Subparagraphs a) and c) of the BiH Criminal Procedure Code, which means due to the flight risk and due to special circumstances justifying the concern that he may repeat the criminal offense, complete the attempted criminal offense or commit the offense he has threatened to commit, which carries a sentence of at least five years of imprisonment.
The Court refused as ill-founded Prosecutor’s Motion to order the suspect Munib Ahmetspahić into custody also on special custody grounds set forth in Article 132(1)d) of the CPC BiH, which is the threat to the safety of citizens and property.
Munib Ahmetspahić is suspected of the criminal offense of Organizing a Terrorist Group under Article 202d(2) as read with Paragraph 1, of the Criminal Code of Bosnia and Herzegovina, all in conjunction with the criminal offense of Terrorism under Article 201 of the Code.
