Ruling on the appeals filed from the Court of BiH Decision No. S1 1 K 024608 18 Krn 13 of 9 November 2018, the Court of Bosnia and Herzegovina partly granted the appeal filed by the BiH Prosecutor’s Office and reversed the contested decision by ordering the custody of suspects Sadik Omanović, Šaćir Omanović, Kasim Kavazović and Almir Sarajlić.
Pre-trial custody was ordered on the custody grounds listed in Article 132(1)b) of the Criminal Procedure Code of Bosnia and Herzegovina (CPC BiH), specifically because of the risk that the suspects might interfere with the witnesses and accomplices and thus hinder the ongoing criminal proceedings. According to the Decision, custody may last for a maximum of one month, running from 8 November 2018 as the day of their arrest.
Prosecutor’s appeal in relation to the suspects Ibrahim Purić, Ibrahim Tarahija, Nijaz Sivra and Rušit Nurković, as well as the appeal filed by suspect Sadik Omanović’s defense counsel, are refused as ill-founded, and Decision No. S1 1 K 024608 18 Krn 13 of 9 November 2018 is upheld in that part.
Ibrahim Purić et al. are suspected of the criminal offense of War Crimes against Prisoners of War under Article 175 of the Criminal Code of Bosnia and Herzegovina (CC BiH) and the criminal offense of War Crimes against Civilians under Article 173 of the CC BiH, all in conjunction with Article 29, and Article 180, Paragraphs 1 and 2 of the CC BiH.
