The Constitutional Court of BiH annulled the results of the referendum that was held on the 25th of September 2016 since the referendum was carried on the basis of the Decision on calling a republican referendum from the 15th of July 2016, for which the Constitutional Court established that it is not in conformity with the Constitution of BiH.
Moreover, the Constitutional Court of BiH adopted the request of Bakir Izetbegovic, member of the Presidency of BiH “to resolve the constitutional dispute with the entity of RS” in relation with the decision on calling a republican referendum from the 15th of July 2016.
It was established that the decision on calling a referendum is not in conformity with Article I / 2 and Article VI / 5 of the Constitution of BiH, because that decision determined the referendum question on which there is already a final and binding decision of the Constitutional Court as an institution of BiH, and such decision must be respected by all the organs and institutions of public government.
All decisions on requests for review of constitutionality and appeals adopted at the meeting will be submitted to the applicants within a month and published on the website of the Constitutional Court of BiH.
When it comes to a referendum in RS, the State Prosecution conducted hearing for several actors of referendum, most members of the Commission for the Referendum in the RS. The invitation came to the President of the RS Milorad Dodik for the criminal acts of non-complying with the decision of the Constitutional Court of BiH, the Court of BiH or the Human Rights Chamber.
